Regardless of who was at fault, it is important to be aware that fatigued driving is one of the primary causes of crashes involving tractor-trailers. Fatigue can affect the driving of some truckers in a way that is similar to being under the influence of alcohol. For example, the Saturday Night Live star, Tracy Morgan, was rear-ended by a semi tractor-trailer where the driver had been driving too long and was overly fatigued. USA Today reported on the story here. Your attorney can most likely find out through a lawsuit whether the driver had been driving too long and was fatigued and argue that this likely contributed to the collision.
